Litigation Matters

Patent Infringement

Represent medical diagnostic testing laboratory in multiple suits including in EDTX and the District of Delaware to enforce its portfolio of patents for cervical cancer testing and related agreements. Matters to date have resulted in settlements. The firm has also assisted the lab in other business disputes with customers and vendors.

Represented a patent owner of a patent for a standing-stroller against multiple infringers pending in several jurisdictions including the Eastern District of Texas. The matters resulted in settlements.

Served as local counsel to Fortune 500 pharmaceutical company in its defense against a patent infringement matter pending in the Eastern District of Pennsylvania. The matter resulted in a settlement.

Served as local counsel to a spa equipment maker in a patent infringement matter pending in the Eastern District of Pennsylvania against a competitor and customer of the competitor. The matter resulted in a settlement.

Trade Secrets Misappropriation and Restrictive Covenants

Representing an algorithmic trading firm and its owners accused of trade secrets misappropriation by one of the owner’s former business partners. ND Galli Law secured a jury verdict in our client’s favor on all of the plaintiff’s claims in a two week trial held in the Spring of 2022 in the Eastern District of Pennsylvania. The trial judge affirmed the jury’s verdict that our clients did not engage in trade secrets misappropriation and did not breach the contracts at issue. The matter is now on appeal to the Third Circuit.

Representing a managed services provider in its claim against a competitor and eleven (11) former employees in a trade secrets misappropriation claim pending in the Eastern District of Michigan.  Matter is still pending.

Representing a business partner and software developer in the medical records management and utilization review industries in two related disputes with his business partners, including over ownership of certain trade secrets and other intellectual property, as well as over the valuation of the business at issue.  Matters are still pending in the District of New Jersey and the Western District of Virginia.

Representing a renewable materials company in two breach of contract and trade secrets disputes with a large foreign company pending in the American Arbitration Association and International Chamber of Commerce.  These matters are still pending.

Represented a professor in his claims of, inter alia, trade secrets misappropriation against his University and another professor pending in the Eastern District of Pennsylvania. Matter resulted in a settlement.

Represented the owner of two spas against a competitor and two former employees in a breach of contract and covenants not-to-compete in the Court of Common Pleas for Montgomery County, Pennsylvania.  The matter resulted in a settlement after we secure a preliminary injunction enforcing the covenant not-to-compete and requiring the two employees to cease their employment with the competitor through the end of the non-compete period.

Trademark and Copyright Matters

Served as local counsel to a novelty picture frame maker in a trademark infringement matter pending in the Eastern District of Pennsylvania brought by a competitor against our client and their mutual customer. The motion to dismiss for lack of personal jurisdiction over our client was granted and the matter was transferred to the client’s home district.

Serve as local counsel to a company in the financial services industry in a trademark infringement matter pending in the Eastern District of Pennsylvania brought by a competitor.  Matter resulted in a settlement.

Served as counsel for the owners of several daycare centers in the Cambridge, Massachusetts area in several disputes relating to their separation from their former franchisor, including over the ownership of certain trademarks.  This matter resulted in a settlement.

Represented a professor in her claims of copyright infringement against her former University in the Eastern District of Pennsylvania.  The matter was voluntarily dismissed without prejudice by agreement.

Represented a toy maker in a trademark cancellation proceeding brought against it by a University in the Trademark Trial and Appeal Board.  The matter resulted in a settlement.

Represented a dog walking service in a trademark opposition proceeding brought against it by a dog walking service in a different geographic region in the Trademark Trial and Appeal Board.  The matter resulted in a settlement.

Represented a motorcycle club in a trademark opposition proceeding it brought in the Trademark Trial and Appeal Board against a former member who was attempting to usurp its mark and brand.  The matter went through trial and resulted in a decision in favor of our client.

Represented a restaurant in a trademark opposition proceeding it brought in the Trademark Trial and Appeal Board against a competitor who was using a conflicting mark.  The matter resulted in a settlement.

Other Business Litigation

Served as local counsel to a pharmaceutical distributor sued for products liability claims in the District of New Jersey.  The matter resulted in a voluntary dismissal without prejudice.

Served as insurance oversight counsel for the owners of two spas against claims of, inter alia, negligence brought by a former employee and three former customers pending in the Court of Common Pleas for Philadelphia County, Pennsylvania. This matter resulted in a settlement.

Serving as counsel for a lender to a real estate developer for a large construction project in Philadelphia.  The project gave rise to multiple litigations pending in the Court of Common Pleas in Philadelphia and our client has been sued for declaratory judgment of no liability by a surety bond issuer that guaranteed the performance of one of the contractors accused of poor performance by the developer.  This matter is currently pending.

Regular trademark counsel for a growing legal staffing firm, advising on trademark portfolio management and assisting in trademark prosecution.

Regular outside counsel for an award-winning podcast producer.  Matters include drafting and reviewing multiple contracts, review and negotiations with customers and joint venture partners, trademark applications and registration matters, employment and independent contractor agreements, website terms and conditions and privacy policy, and general corporate and IP counseling.

Regular outside counsel for a boutique stationery company.  Matters include multiple drafting, review and negotiations for in-bound and out-bound license agreements, agent agreement, influencer agreements, trademark application and registration matters, employment and independent contractor agreements, website terms and conditions and privacy policy, and general corporate and IP counseling.

Regular outside counsel for a fashion industry consultancy.  Matters include drafting and reviewing multiple contracts, negotiations with customers and joint venture partners, influencer agreements, employment and independent contractor agreements, web developer agreements, and general corporate and IP counseling.

Regular outside counsel for a non-alcoholic beverage company, assisting the company in business disputes and trademark prosecution.

Assisted a renowned artist in securing trademark and copyright protection for artwork related to a widely recognized advocacy project that has appeared in Times Square and in other prominent locations.  Also assisted the artist in pursuing infringement of his intellectual property by a large beverage manufacturer.

Serve as corporate, trademark and IP counsel on an as-needed basis for numerous businesses including in the life sciences, health care, food and beverage, fashion, financial, marketing, and professional services industries, among others.

Assisted majority woman owner of a utility contractor in in securing certification as a women-owned business from WBENC and in her joint venture with a major utility contractor.
